The issue of whether or not there are visual arguments has been an issue in informal logic and argumentation theory at least since 1996. In recent years, books, sections of prominent conferences and special journals issues have been devoted to it, thus significantly raising the profile of the debate. In this paper I will attempt to show how the views of the later Wittgenstein, particularly his views on images and the no- tion of “picturing”, can be brought to bear on (...) the question of whether there are such things as “purely visual” arguments. I shall draw on Wittgenstein’s remarks in the Blue and Brown Books and in Philosophical Investigations in order to argue that al- though visual images may occur as elements of argumentation, broadly conceived, it is a mistake to think that there are purely visual arguments, in the sense of illative moves from premises to conclusions that are conveyed by images alone, without the support or framing of words. In this paper I begin by examining Fogelin’s account of deep disagreement. My contention is that this account is so deeply flawed as to cast doubt on the possibility that such deep disagreements actually happen. Nevertheless, I contend that the notion of deep disagreement itself is a useful theoretical foil for thinking about argumentation. The second part of this paper makes this case by showing how thinking about deep disagreements from the perspective of rhetoric, Walton-style argumentation theory, computation, and normative (...) pragmatics can all yield insights that are useful no matter what one’s orientation within the study of argument. Thus, I conclude that deep disagreement –even if it were to turn out that there are no real-world occurrences of it to which we can point–is useful for theorists of argumentation. In this wise, deep disagreement poses a theoretical challenge for argumentation theory not unlike that posed by radical skepticism for traditional epistemology. (shrink)

Geoff Goddu's 2010 paper "Is 'Argument' subject to the process/product ambiguity?" and Paul Simard-Smith and Andrei Moldovan's 2011 paper “Arguments as abstract objects” have revived the dialogue about what might be called the "metaphysics of argument". Both papers are important. Both also seem to me to be open to significant objections. In this paper I will lay out some of these objections and give, in rough outline, the kernel of an alternative approach.

In lieu of an abstract, here is a brief excerpt of the content:242 HISTORY OF PHILOSOPHY his political and religious predispositions prodded him to demonstrate that the roots of modern science were in the Christian Middle Ages. Sarton's particular foibles are best understood by referring them to his pacifist commitments and the moralistic assumption that the values of science are transferable to other human endeavors. Categories such as inductivism, conventionalism and Popperianism are of little help in gaining historical understanding. For (...) this, they are in fact Platonic ideals which have little heuristic value. I would venture that a truly historical historiography of science would aid us in spotting errors in the past and help us in the future. My guess is that a good analysis would reveal a major source of trouble to have stemmed from preconceived notions which the history of science was meant to illustrate. Surely some of them have been philosophical in character, and even Baconian or conventionalist. But until recent times, most of these preconceptions have stemmed from religious, nationalistic, or personal motivations, or from scientists who wanted support for a particular concept. I agree with Agassi only in the suggestion that a parti pris was at the root of our troubles. Why, then, substitute a Popperian preconception for a conventionalist one? Why not, on the contrary, combat their distorting influence and reduce their impact? This is in fact what has happened in recent times. As the history of science has fallen into the hands of a gradually organized profession, the blatant motivations --of any type--which colored past historical writings have slowly receded. By a constant and critical confrontation of opposing views among specialists, the purpose for examining the history of science has slowly been transformed. The older external motivations have given way to an interest in the subject for its own sake and a gradual transformation has been in the making for the last few decades. As happens in other human endeavors, professionalization has already raised the standards in the discipline and there is every reason to think it will continue to do so in the future. Descartes maintained that God freely created all eternal truths. Yet, while it is impossible for necessary truths to have been otherwise, if they are a matter of God’s free choice, then it seems that they could have been otherwise. Adrian W. Moore (2020) offers a solution to this conflict that, he claims, Descartes “could and should” have adopted. This article argues that Descartes’s position is in a sense closer to Moore’s solution than Moore permits, yet proposes an arguably more accurate (...) account via the Cartesian relationship between omnipotence, indifference, and the dependence of the eternal truths on God. Omnipotence and indifference do not express that God might have created the necessary truths in another way, but rather that God’s decrees are in no way determined by anything other than God. Thus, alternative possibilities are not relevant to this account, since there were none before God’s creative act. (shrink)

Drawing from Goffman’s original observations on stigma and the consequences of interactions between the stigmatized and supportive or stigmatizing audiences, we conduct a 20-year review of the diverse literature on stigma to revisit the collective nature of stigmatization processes. We find that studies on stigma’s origins, responses, processes, and outcomes have diverged from Goffman’s relational view of stigma as they have overlooked important relational mechanisms explaining the processes of (de)stigmatization. We draw from those conclusions to justify the need to study (...) stigma as a collective phenomenon. We develop a relational perspective on stigma based on understanding how attributes are stigmatized (or not) by audiences in their interactions. We argue that to advance stigma research, it is necessary to build on Goffman’s theory to include the stigmatizers (i.e., the normal) and supporters (i.e., the wise); how they create, sustain, or remove stigma; and how they relate to the stigmatized (i.e., the targets). Accordingly, we provide a research agenda on stigma as a collective phenomenon that theorizes a relational perspective, proposes a typology of how audiences relate to stigmatization, and identifies patterns of relations between audiences. We thus offer a missing piece to existing accounts of stigma by focusing on the key role of audiences (i.e., stigmatizers or supporters of the stigmatized) rather than on the targets of stigma (i.e., the own). We estimate that 208,000 deep brain stimulation (DBS) devices have been implanted to address neurological and neuropsychiatric disorders worldwide. DBS Think Tank presenters pooled data and determined that DBS expanded in its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. The DBS Think Tank was founded in 2012 providing a space where clinicians, engineers, researchers from industry and academia discuss current and emerging DBS technologies and logistical and ethical issues facing the field. (...) The emphasis is on cutting edge research and collaboration aimed to advance the DBS field. The Eighth Annual DBS Think Tank was held virtually on September 1 and 2, 2020 (Zoom Video Communications) due to restrictions related to the COVID-19 pandemic. The meeting focused on advances in: (1) optogenetics as a tool for comprehending neurobiology of diseases and on optogenetically-inspired DBS, (2) cutting edge of emerging DBS technologies, (3) ethical issues affecting DBS research and access to care, (4) neuromodulatory approaches for depression, (5) advancing novel hardware, software and imaging methodologies, (6) use of neurophysiological signals in adaptive neurostimulation, and (7) use of more advanced technologies to improve DBS clinical outcomes. There were 178 attendees who participated in a DBS Think Tank survey, which revealed the expansion of DBS into several indications such as obesity, post-traumatic stress disorder, addiction and Alzheimer’s disease. The just war tradition is an evolving body of tenets for determining when resorting to war is just and how war may be justly executed. Rethinking the Just War Tradition provides a timely exploration in light of new security threats that have emerged since the end of the Cold War, including ongoing conflicts in the Middle East, threats of terror attacks, and genocidal conflicts within states. The contributors are philosophers, political scientists, a U.S. Army officer, and a senior analyst at (...) the Center for Defense Information. They scrutinize some familiar themes in just war theory from fresh and original angles, and also explore altogether new territory. The diverse topics considered include war and the environment, justice in the ending of war, U.S. military hegemony, a general theory of just armed-conflict principles, supreme emergencies, the distinction between combatants and noncombatants, child soldiers, the moral equality of all soldiers, targeted assassination, preventive war, right authority, and armed humanitarian intervention. Clearly written and free of jargon, this book illustrates how the just war tradition can be rethought and applied today. In her 2007 paper, “Argument Has No Function” Jean Goodwin takes exception with what she calls the “explicit function claims”, arguing that not only are function-based accounts of argumentation insufficiently motivated, but they fail to ground claims to normativity. In this paper I stake out the beginnings of a functionalist answer to Goodwin.

In this dissertation I argue that the concept of a moral right is best explicated by means of the concept of morally legitimate coercion. This thesis, which I call the enforceability thesis, says that to have a right is to have a claim such that one would be justified in pursuing a course of action up to and including harm should the claim be dissatisfied. I contend that this thesis, if it is true, explains much about our intuitions concerning moral (...) rights, accounts for the historical importance of rights-talk in the context of events such as revolutions and political reforms, and explains why rights are a necessary part of the moral vocabulary. If rights do not set out conditions under which coercion is morally appropriate, then they do nothing that other moral concepts could not do. ;Drawing on the work of H. L. A. Hart, John Rawls, and others, I argue that the philosophical strength and practical efficacy of rights on the enforceability thesis is best realized when rights are treated as action-guiding principles set within a framework of moral decision making under reflective equilibrium. Using the process of reflective equilibrium as a backdrop, I argue that rights can have sufficient normative force to play an important role in moral and political theory without being either impracticably stringent or subject to so many exceptions that they lose their efficacy. ;With this background in place I next set out and argue for a view of human rights which, because human rights turn out to be best understood as rights to primary goods, I call the theory of primary rights. The account I give of primary rights emphasizes their justificatory place in arguments for coercion, their importance to the moral integrity of the individual, and the practical applicability of the overarching theory of rights developed in this dissertation. Descartes says that the Meditations contains the foundations of his physics. But how does the work advance his geometrical view of the corporeal world? His argument for this view of matter is often taken to be concluded with the proof of the existence of bodies in the Sixth Meditation. This paper focuses on the work that follows the proof, where Descartes pursues the question of what we should think about qualities such as light, sound and pain, as well as the (...) size and shape of particular bodies. His inquiry makes crucial use of the notion of a teaching of nature originating from God, as contrasted with an apparent teaching of nature originating from habit. I attempt to reconstruct Descartes's use of these notions in order to clarify the way in which he makes space for his geometrical conception of the corporeal world. (shrink)

This article synthesizes research presented in several models of unethical behavior to develop propositions about the factors that facilitate and mitigate deception in online business communications. The work expands the social network perspective to incorporate the medium of communication as a significant influence on deception. We go beyond existing models by developing seven propositions that identify how social network and issue moral intensity characteristics influence the probability of deception in online business communication in comparison to traditional communication channels. Prior researchers have studied individual components of a theoretical decision-making model. This paper presents the results of a more complete study of the model components and presents limited support of theory. The study examines the relative importance of regulatory, organizational, and personal constructs on an individual''s ethical sensitivity. Auditors from the major international accounting firms, located in two southeastern cities, are surveyed. Structural equation modeling is used to allow for the simultaneous evaluation of the three constructs of interest. The results (...) indicate that the regulatory and organizational constructs are negatively correlated with the personal experience construct. The three constructs are not significant causal factors on ethical sensitivity. This result may be due to the manner in which ethical sensitivity is typically measured or may indicate that the complexity of the ethical decision-making process is not fully captured in the theoretical models. Thus, the models suggested in the prior literature and the results presented in prior studies of the individual components may need to be reconsidered. (shrink)

In a recent comment on H.L.A. Hart’s ‘Postscript’ to The Concept of Law, Ronald Dworkin claims that the meaning of legal and political concepts may be understood by analogy to the meaning of natural kind concepts like ‘tiger’, ‘gold’ and ‘water’. This article questions the efficacy of Dworkin’s claims by challenging the use of natural kinds as the basis for a semantic theory of legal and political concepts. Additionally, in matters of value there is no methodological equivalent to the scientific (...) method. Thus, there is little hope of finding hidden essences to explain the meaning of legal and political concepts. Finally, even if there are natural kinds, Dworkin’s arguments for their efficacy in jurisprudence are problematic and unpersuasive. The problem for Dworkin is that his embrace of natural kinds undermines the ‘fit’ side of the fit/justification model of adjudication that lies at the heart of his theory of law. (shrink)

Partly due to the influence of Tarski's work, it is commonly assumed that any good theory of truth implies biconditionals of the sort mentioned in Convention T: instances of the T-Schema "s is true in L if and only if p" where the sentence substituted for "p" is equivalent in meaning to s. I argue that we must take care to distinguish the claim that implying such instances is sufficient for adequacy in an account of truth from the claim that (...) doing so is necessary. The claim that doing so is sufficient is a common component of deflationary theories of truth, while the claim that it is necessary, though often assumed, must be denied by proponents of rival inflationary theories of truth. I discuss the clarification of the debate between these views of truth that results from distinguishing the necessity and the sufficiency claims, and examine the prospects for its resolution. Descartes first invokes the errors of the senses in the Meditations to generate doubt; he suggests that because the senses sometimes deceive, we have reason not to trust them. This use of sensory error to fuel a sceptical argument fits a traditional interpretation of the Meditations as a work concerned with finding a form of certainty that is proof against any sceptical doubt. If we focus instead on Descartes's aim of using the Meditations to lay foundations for his new science, (...) his appeals to sensory error take on a different aspect. Descartes's new science is based on ideas innate in the intellect, ideas that are validated by the benevolence of our creator. Appeals to sensory error are useful to him in undermining our naïve faith in the senses and guiding us to an appreciation of innate ideas. However, the errors of the senses pose problems in the context of Descartes's appeals to God's goodness to validate innate ideas and natural propensities to belief. A natural tendency to sensory error is hard to reconcile with the benevolence of our creator. This paper explores Descartes's responses to the problems of theodicy posed by various forms of sensory error. It argues that natural judgements involved in our visual perception of distance, size and shape pose a problem of error that resists his usual solutions. (shrink)

This paper takes issue with Tyler Burge's claim that intentional states are nonindividualistically individuated in cognitive psychology. A discussion of current models of children's acquisition of semantic knowledge is used to motivate a thought-experiment which shows that psychologists working in this area are not committed to describing the concepts children attach to words in terms of the concepts standardly attached to those words in the child's community. The content of the child's representational states are thus not individuated with reference to (...) linguistic environment in the manner that Burge's nonindividualistic view requires. The paper concludes that the explanatory states of cognitive psychology are sometimes individualistically individuated. (shrink)
